The paper defends a better balance of information and interests in the bankruptcy process, increasing the decision-making rights of creditors, and practicing greater regulatory and judicial forebearance, which, by taking into account not only comparative advantages but also limitations that suffer legislators and judges, would allow a more fruitful interaction of the legal order with the private ordering solutions designed by corporate stakeholders.
